WorkHub Privacy Policy

Effective Date: October 13, 2026

1. Introduction and Scope. WorkHub Ventures, LLC, together with its affiliates and subsidiaries ("WorkHub," "we," "us," or "our"), owns and operates the website located at www.workhubusa.com and related pages, forms, and online tools (collectively, the "Site"). This Privacy Policy describes how we collect, use, disclose, and protect personal information when you visit the Site, request information about our flex warehouse and office space, schedule a tour, apply for our broker program, subscribe to our communications, or otherwise interact with us. WorkHub determines the purposes for which this information is collected and used and, where applicable law uses these terms, is the data controller or business. This Privacy Policy does not replace separate notices that may apply to employment, tenant screening, or payment processing. By using the Site, you agree to the practices described in this Privacy Policy.

2. Information We Collect. We collect the following categories of personal information:

(a) Information you provide to us. When you fill out a form on the Site, schedule a tour, use our "Find your space" search, submit a unit request, register for our broker program, subscribe to WorkHub Magazine or other communications, or contact us, we may collect your name, email address, telephone number, company name, role, business type, space requirements, preferred location and timing, and any other information you choose to provide.

(b) Communication, consent, and preference records. We keep records of our correspondence with you, your subscription status, your opt-in and opt-out history, and the evidence supporting the permissions you have given us. Recordings or transcripts of calls or meetings, if used, are subject to any required notice.

(c) Information collected automatically. When you visit the Site, we and our service providers automatically collect certain information from your device, including IP address, browser type, operating system, device identifiers, referring URLs, pages viewed, links clicked, and interaction with our messages. This information is collected through cookies, pixels, tags, and similar technologies as described in Section 7.

(d) Information from third parties. We may receive information about you from commercial real estate brokers, listing platforms, marketing partners, and publicly available sources, and we may combine it with information we collect directly.

(e) Sensitive information. Please do not submit payment card details, government identifiers, health information, or other sensitive personal information through general inquiry forms or chat unless we specifically request it through an appropriate secure process.

3. How We Use Personal Information. We use personal information to respond to your inquiries; coordinate and conduct property tours; match you with available space and process lease applications; manage our relationships with tenants, prospective tenants, brokers, and vendors; send marketing and promotional communications by email, telephone, and text message where we have the necessary permission; maintain your communication preferences and honor opt-outs; operate, analyze, and improve the Site and our services, including measuring the performance of our marketing campaigns; protect our systems and prevent fraud and misuse; and comply with legal obligations and enforce our agreements. Where applicable law requires a lawful basis, we rely on your consent, steps taken at your request before entering a contract, performance of a contract, a legal obligation, or our legitimate interests, as appropriate to each purpose. Keeping a business record does not by itself authorize promotional outreach through every channel.

4. Consent and Communication Preferences. We treat permission to process personal information, permission to send promotional communications, and permission to use optional tracking technologies as separate choices. Providing information for an inquiry allows us to handle that inquiry; it does not by itself establish consent to unrelated promotional messages or to every communication channel. Agreeing to receive promotional messages by email does not authorize text messages, and vice versa. When we rely on consent for promotional communications, we obtain a clear affirmative choice that identifies the sender and the type of communication, and we keep records of how that permission was obtained. You may withdraw consent or change your preferences at any time as described in Section 8.

5. Text Messaging (SMS). If you opt in to receive text messages from WorkHub, we will use your mobile telephone number to send you the messages described in our SMS Terms and Conditions. Your consent to receive text messages is not a condition of leasing space from us or of any purchase, and is separate from any other permission you have given us. Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP to any message. Mobile opt-in information, including your telephone number and consent, will not be shared with or sold to third parties or affiliates for their own marketing purposes. Please review our SMS Terms and Conditions for additional information.

6. Automated Follow-Up and Service Providers. We use HubSpot and other providers to operate our forms, scheduling tools, customer relationship management, communications, and analytics. A request for information, a scheduled tour, or a recorded business interest may cause your record to enter an automated process that updates our records, notifies our staff, or schedules follow-up. Entering such a process is not the same as consenting to marketing, and we do not treat a new inquiry as renewal of consent you have withdrawn. For personal information processed on our behalf, HubSpot acts as our processor or service provider under its Data Processing Agreement and applies safeguards including access controls, encryption in transit and at rest, monitoring, and incident response. HubSpot may use affiliates and authorized subprocessors, and information may be processed internationally as necessary to provide the service. WorkHub remains responsible for how it obtains personal information, the notices and permissions it provides, and its responses to privacy requests. Where we use AI-assisted features, relevant information may be processed to support that functionality under the applicable provider terms and our account settings.

7. Cookies and Tracking Technologies. The Site uses cookies, web beacons, tags, and similar technologies, to recognize your device, understand how the Site is used, personalize content, associate website activity with your business record, and deliver and measure advertising. These technologies fall into the following categories: (i) necessary technologies that operate the Site, forms, chat, and scheduling tools, including HubSpot; (ii) analytics technologies that help us understand how the Site is used, including Google Tag Manager, Google Analytics, and Microsoft Clarity, which records how visitors interact with Site pages, such as clicks, scrolling, and mouse movement; and (iii) advertising technologies that deliver and measure advertising and build audiences on advertising platforms, including Google Ads, Meta Pixel, LinkedIn Insight Tag, OpenAI advertising pixel, and HubSpot Ads. Advertising technologies may track your activity across other websites over time. When you first visit the Site, a cookie banner allows you to accept or reject analytics and advertising technologies, and you can change your choices at any time through the cookie settings link on the Site or through your browser settings; disabling cookies may limit certain features. Accepting cookies does not constitute consent to promotional messages. The Site does not currently respond to "Do Not Track" browser signals; however, we honor Global Privacy Control signals where required by applicable law.

8. Your Choices. You may unsubscribe from marketing emails through the unsubscribe or preference link in any marketing email; opt out of text messages by replying STOP to any message; manage cookies as described in Section 7; and request access to, correction of, or deletion of your personal information by contacting us as described in Section 14. We will honor applicable opt-out requests and may retain a limited suppression record to prevent future unwanted outreach. We may continue to send non-promotional messages about a requested service or an existing relationship where legally permitted; such messages will not be used to bypass a promotional opt-out. An unsubscribe request is different from a request to delete personal information.

9. How We Share Personal Information. We do not sell personal information for money. However, through the advertising technologies described in Section 7, we disclose identifiers, device and browser information, and Site activity to Google, Meta, LinkedIn, OpenAI, and HubSpot for targeted advertising, remarketing, and campaign measurement. This disclosure may be considered a “sale,” “sharing,” or “targeted advertising” under certain state privacy laws, and you may opt out as described in Section 10. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the Text Message services. We may share personal information with service providers that perform services on our behalf, including HubSpot and providers of website hosting, email and text message delivery, analytics, and advertising, who may use it only to perform services for us; with our affiliated entities, including the property-owning entities that own and operate the WorkHub locations; with commercial real estate brokers or partners involved in your transaction; with professional advisers, authorities, or other parties where required by law or necessary to protect our rights, investigate misuse, or resolve disputes; and with relevant parties in a merger, acquisition, financing, reorganization, or sale of all or part of our business, subject to appropriate protections.

10. State Privacy Rights. Depending on where you reside, you may have rights under state privacy laws, including the Texas Data Privacy and Security Act and the California Consumer Privacy Act as amended by the California Privacy Rights Act. These rights may include the right to know what personal information we collect and how it is used and shared; the right to access a copy of your personal information; the right to correct inaccurate information; the right to delete your personal information; the right to opt out of the sale or sharing of personal information and of targeted advertising; and the right not to be discriminated against for exercising these rights. To the extent our use of advertising cookies constitutes "sharing" or "targeted advertising" under applicable law, you may opt out by rejecting advertising cookies in the cookie banner or the “Do Not Sell or Share My Personal Information” cookie settings link on the Site, by enabling a Global Privacy Control signal in your browser, or by contacting us. To exercise any of these rights, contact us as described in Section 14. We may need to verify your identity before responding, and you may designate an authorized agent subject to verification. If we deny your request, you may appeal by contacting us and referencing the original request.

11. Data Retention and Security. We retain personal information for as long as reasonably necessary to manage inquiries and relationships, comply with legal, accounting, and reporting obligations, resolve disputes, enforce our agreements, and maintain evidence of your preferences. We implement reasonable administrative, technical, and physical safeguards designed to protect personal information, and we restrict access to authorized personnel. Deletion requests may be subject to legal exceptions, and backup copies may remain protected until removed under our normal deletion cycles. No method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

12. Children and Third-Party Websites. The Site is intended for business users and is not directed to children under the age of 18; we do not knowingly collect personal information from children. The Site may contain links to third-party websites, including social media platforms, that are not operated by us. This Privacy Policy does not apply to those third parties, and we encourage you to review their privacy policies.

13. Changes to This Privacy Policy. We may update this Privacy Policy from time to time. The effective date at the top indicates when it was last revised. Material changes will be posted on the Site, and your continued use of the Site after the effective date constitutes acceptance of the revised Privacy Policy. An update does not by itself create new consent for a materially different purpose.

14. Contact Us. If you have questions about this Privacy Policy or wish to exercise your rights, please contact us at WorkHub Ventures, LLC, 1780 Hughes Landing Blvd, Suite 670, The Woodlands, TX 77380, or by email at leasing@workhubusa.com.
